# ComOS Acceptable Use Policy

## 1. Introduction
This Acceptable Use Policy ("AUP") governs your use of the ComOS platform ("Platform"), operated by **ComOS Federation, Inc.**, a Delaware corporation (incorporated; effective July 20, 2026), and is incorporated by reference into our [Terms of Service](/legal/terms-of-service). Capitalized terms not defined here have the meanings given in the Terms of Service.
By using the Platform, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account.

## 2. Our Role as Infrastructure Provider
### 2.1 Platform Positioning
ComOS is a commerce operating system—infrastructure that enables merchants to conduct business. **We are a technology provider, not a marketplace, retailer, or curator of products.**
### 2.2 No Endorsement
**ComOS does not review, approve, endorse, or take responsibility for any products, services, or content offered by Merchants through the Platform.** The presence of a Merchant or product on the Platform does not imply ComOS's endorsement, recommendation, or verification of quality, safety, legality, or accuracy.
### 2.3 Merchant Responsibility
**You are solely responsible for ensuring that all products, services, content, and business practices comply with all applicable laws and regulations.** This includes responsibility for:
- Product legality and safety
- Accurate product descriptions and claims
- Compliance with consumer protection laws
- Proper licensing and certifications
- Tax collection and remittance
- Intellectual property rights

## 3. Prohibited Products and Services
You may not use the Platform to sell, promote, or facilitate the sale of the following:
### 3.1 Illegal Products and Services
- Products or services illegal under federal, state, or local law
- Products illegal in the jurisdictions where you or your customers are located
- Counterfeit or stolen goods
- Products that require a license you do not possess
### 3.2 Regulated and Dangerous Items
- Illegal drugs, controlled substances, or drug paraphernalia
- Prescription medications without proper licensing
- Weapons, firearms, ammunition, or explosives (except as permitted by law and payment processor)
- Items designed to harm others
### 3.3 Adult Content and Services
- Pornography or sexually explicit content
- Adult services
- Content involving minors in any inappropriate context
### 3.4 Gambling and High-Risk Financial Services
- Illegal gambling or lottery services
- Unregistered securities or investment schemes
- Cryptocurrency or NFT sales (unless compliant with payment processor requirements)
- Pyramid schemes or multi-level marketing that violates FTC guidelines
### 3.5 Deceptive or Harmful Products
- Products with false or misleading health claims
- Fake reviews or engagement services
- Counterfeit or knockoff products
- Products that infringe intellectual property rights
### 3.6 Payment Processor Prohibited Categories
You must also comply with prohibited business categories of our payment processors (currently Stripe). Payment processor prohibited categories are incorporated by reference and may include additional restrictions beyond those listed above.

## 4. Prohibited Activities
### 4.1 Fraudulent or Deceptive Practices
You may not:
- Engage in fraud, scams, or deceptive business practices
- Misrepresent products, services, or business identity
- Use fake reviews, testimonials, or endorsements
- Engage in bait-and-switch tactics
- Charge for products or services not delivered
### 4.2 Intellectual Property Violations
You may not:
- Infringe copyrights, trademarks, patents, or trade secrets
- Sell counterfeit goods
- Use others' intellectual property without authorization
- Violate licensing agreements
### 4.3 Spam and Unauthorized Communications
You may not:
- Send unsolicited commercial messages (spam)
- Violate CAN-SPAM, GDPR, or other communication laws
- Harvest or collect customer data for unauthorized purposes
- Sell or share customer data with third parties
### 4.4 Security Violations
You may not:
- Attempt to access other Merchants' accounts or data
- Probe, scan, or test system vulnerabilities
- Circumvent security measures or access controls
- Introduce malware, viruses, or malicious code
- Conduct denial-of-service attacks
### 4.5 Platform Abuse
You may not:
- Use the Platform in ways that degrade service for others
- Circumvent usage limits or rate limiting
- Create multiple accounts to evade restrictions
- Reverse engineer or copy the Platform
- Use the Platform to build a competing product
- Resell Platform access without authorization
### 4.6 Legal Violations
You may not:
- Violate any applicable law or regulation
- Facilitate illegal activities by third parties
- Evade taxes or assist in tax evasion
- Violate export controls or sanctions
- Engage in money laundering

## 5. Manager Conduct
### 5.1 Manager Responsibilities
If you are a Manager on a Merchant account, you acknowledge that:
- Your actions are binding on the Merchant account
- You must operate within the permissions granted by the Owner
- You must comply with this AUP in all Platform activities
- You may not authorize products or activities prohibited by this AUP
### 5.2 Manager Liability
The Merchant (Owner) is responsible for all Manager actions. However, Managers may be individually liable for:
- Intentional violations of this AUP
- Unauthorized access or actions beyond assigned permissions
- Fraudulent activity

## 6. Reporting and Enforcement
### 6.1 Reporting Violations
To report a potential violation of this AUP, contact us at:

- Subject line: "AUP Violation Report"
Include:
- The Merchant or account in question
- Description of the violation
- Any supporting evidence
### 6.2 Investigation
We may investigate reported or suspected violations. During investigation, we may:
- Request information or documentation from you
- Temporarily suspend access
- Preserve evidence for legal proceedings
### 6.3 Enforcement Actions
Upon determining a violation, we may take one or more of the following actions:
**Warning:** Written notice of the violation with required corrective action.
**Content Removal:** Removal of violating products, content, or listings.
**Feature Restriction:** Limiting access to specific Platform features.
**Suspension:** Temporary suspension of account access.
**Termination:** Permanent termination of your account.
**Legal Action:** Referral to law enforcement or initiation of legal proceedings.
### 6.4 Factors Considered
When determining enforcement action, we consider:
- Severity and nature of the violation
- Whether the violation was intentional
- Prior violations or warnings
- Impact on customers, the Platform, or other Merchants
- Cooperation during investigation
### 6.5 Appeals
You may appeal enforcement actions by contacting support@comos-federation.com within 14 days of the action. Appeals are reviewed and decided at our discretion.

## 7. Cooperation with Law Enforcement
We cooperate with law enforcement agencies investigating illegal activities. We may disclose information about your account and activities when:
- Required by law, subpoena, or court order
- Necessary to prevent fraud or harm
- Requested by law enforcement with proper legal process

## 8. Changes to This Policy
We may update this AUP to reflect changes in law, Platform capabilities, or business practices. Material changes will be communicated with 30 days' notice. Continued use after changes constitutes acceptance.
